Introduction

1. This Personal Data Protection Notice explains how the PTPTN Loan Repayment Postponement Portal uses the personal data of applicants who apply for the postponement of PTPTN loan repayments.
2. PTPTN is highly committed to ensuring that personal data is processed in compliance with the Personal Data Protection Act 2010 [Akta 709] in implementing the loan repayment postponement initiative.
3. This notice pertains to the personal data shared by applicants for the purpose of applying for the postponement of PTPTN loan repayments.

The Notice's Purpose

4. This notice is issued to anyone wishing to apply for PTPTN loan repayment postponement.

Purpose of Personal Data Processing

5. PTPTN shall process personal data for the following purposes:

a) Assessing the applicant's eligibility;

b) Verifying the applicant's personal details;

c) Collecting information for analysis and reporting to relevant authorities; and

d) Any other purposes required or permitted by any laws, regulations, guidelines, court orders, or relevant regulatory authorities.

Disclosure of Personal Information

6. Specific personal data related to the applicant may need to be disclosed to third parties, such as the following:

a) Any reputable agency that requires PTPTN to do so in accordance with the law;

b) Any party involved in or related to legal proceedings for the purpose of legal proceedings;

c) Government agencies, other statutory bodies including the Inland Revenue Board (LHDN), the Employees Provident Fund (KWSP), and the Social Security Organization (PERKESO) not involved in the PTPTN loan repayment postponement initiative; and

d) Any person permitted by law.

7. Subject to the law, PTPTN will only disclose relevant personal data to third parties as stated in paragraph 6. Furthermore, applicants may, in writing, notify PTPTN to limit the use of their personal data, subject to the law.

Data Security

8. PTPTN shall take practical steps to protect personal data and maintain its confidentiality.
9. PTPTN shall store and process the applicant's data securely, ensuring appropriate management and compliance with laws to protect personal data from any loss, misuse, alteration, unauthorized access, or disclosure, as well as from any accidental alteration or destruction.
10. If PTPTN provides any personal data to any third party, they shall take practical steps to ensure that the third party consistently protects the applicant's personal information and does not use the applicant's personal information for any purpose other than for the purpose of the loan repayment postponement initiative.

Personal Data Storage

11. In accordance with Section 10 of Act 709, personal data processed for the purpose of the PTPTN loan repayment postponement initiative shall not be retained longer than necessary to fulfill that purpose. All personal data shall be destroyed or permanently deleted if it is no longer required for the purpose of the PTPTN loan repayment postponement initiative.

The Applicant's Right to Access and Amend Personal Data

12. The applicant shall ensure that the personal data provided to PTPTN for the purpose of the PTPTN loan repayment postponement initiative is accurate, complete, not misleading, and up-to-date. Any recent changes to personal data shall be promptly reported to PTPTN

a) Verify whether PTPTN indeed processes or uses their personal data for the PTPTN loan repayment postponement initiative and request access to such data;

b) Request to amend any of their Personal Data found to be inaccurate, incomplete, misleading, or not up-to-date, and be provided with a copy of their current personal data;

c) Notify in writing any objection to the use of their personal data for any purpose, and PTPTN will not use the personal data for purposes not authorized by the applicant; and

d) Notify in writing the complete or partial withdrawal of consent for the sharing of any of the applicant's personal data.

14. By making an application through the PTPTN Loan Repayment Deferral Portal, the applicant is considered to have consented to allow PTPTN to collect, record, hold, store, process, and manage the applicant's personal data, unless consent for the sharing of any personal data is withdrawn under subparagraph 13(d).
15. PTPTN may amend the terms in this Personal Data Protection Notice at any time by posting the updated Personal Data Protection Notice on the website or portal. Applicants are subject to any such amendments.
